In its December 2016 decision in Patriot Solutions, LLC, the GAO ordered the government to re-evaluate or redraft and re-bid a corrugated containers RFP. While the original RFP rules stated that the award would go to the highest score, the government ultimately bypassed the high score and awarded to the lowest price. The high-scoring proponent challenged the evaluation. The GAO ordered the government to either re-evaluate the proposals and award to the highest score or, if it could not justify awarding to a higher price, cancel the process, redraft a low bid solicitation, and retender the requirement.
