Paul Emanuelli

General Counsel and Managing Director

Paul Emanuelli is an internationally known author and procurement lawyer with over twenty years experience in public procurement. He has an extensive track record of public speaking, publishing and training and was recognized by Who’s Who Legal as one of the top ten public procurement lawyers in the world.

Paul’s portfolio focuses on major procurement projects with an emphasis on technology and public infrastructure. He has in-depth experience advising public bodies on the legal and strategic aspects of institutional governance and supply chain management, developing tendering formats and negotiating commercial transactions.

Paul is currently the Program Director of Osgoode Professional Development’s Certificate in Public Procurement Law and Practice and the Advanced Certificate in Procurement Law and Practice and an instructor with the University of West Indies Faculty of Law. He is the author of multiple publications, including the leading textbook Government Procurement (Lexis Nexis-Butterworths, 4th ed. 2017).

Before launching the Procurement Office, Paul practiced for over ten years as Crown Counsel with the Ontario Attorney General at Management Board Secretariat and Crown Law Office Civil, and headed the Government of Ontario’s Procurement Lawyers Group.

Registration and Facilities Booking System BAFO (2017) – Large Ontario Municipality

Provided strategic legal advice, including negotiated RFP drafting services and related process advice, for a Best and Final Offer NRFP for the acquisition of a multi-million dollar program registration and facilities/space booking system for a high-volume city-wide recreational program.

Bus Route Optimization Software BAFO (2016) – Education-Sector Purchasing Group

Provided strategic advice, legal review and drafting services for the planning and development of a BAFO RFP for an externally hosted software-as-a-service bus route optimization software solution accessible to participating school boards province-wide.

Maintenance Management System NRFP (2016) – Regional Municipality

Provided an RFP review, drafting assistance and project support for a flexible negotiated RFP for an Enterprise Maintenance Management System that invited proposals for either an on-premise solution, a cloud solution, or a combination of both.

Opinion on Procurement Obligations – Crown Corporation (2016)

Provided opinion setting out procurement obligations under applicable laws and treaties and providing advice in relation to implications of Agreement on Internal Trade expansion.

Rebuttal Expert Opinion – Municipality (2015)

Prepared rebuttal report for purchaser in response to complainant’s expert opinion report on a lost profit claim of an unsuccessful bidder in relation to a services tender connected to a major construction project.

Conducted a custom overhaul of client’s full suite of tendering templates, including extensive tailoring of custom construction tender documents, construction management RFP documents, and trades and services tender documents.

Served on panel on behalf of the Ontario Minister of Education in connection with a review of student transportation task force, with focus on establishing vendor of record/open framework agreements.
