In an attempt to shield themselves from public access requests, many government institutions are treating the notes of individual evaluators as “transitory records” and are only keeping the final consensus scoring results of their evaluation teams. However, failing to maintain proper evaluation records undermines the defensibility of the public procurement process. This webinar will survey a number of recent cases where going off the record caused an evaluation process to go off the rails and resulted in the nullification of the resulting contract award.
